Crane Regulations for the Port of Kalundborg

The hire of cranes is subject to the following terms and conditions:

1.

Use of cranes

1.1.

The Port of Kalundborg provides cranes to hirers along with an operator.

The hirer is responsible for familiarising themselves with the laws, executive orders, and other regulations applicable to the hire and use of cranes, including the rules issued by the Danish Ministry of Employment regarding the operation (rigging), storage, and labelling of lifting equipment, as well as the design and operation of cranes, and for ensuring compliance with these rules and regulations.

1.2

The crane must not swing loads over a vessel other than the one it is serving, and the crane operator is only required to operate the crane in ways that align with its design and intended function.

1.3

Electric cranes travelling on tracks must not move along the quay while carrying loads. If it becomes necessary to move a quay crane, the crane hirer or their representative must ensure that the crane runway, tracks, and cable tray are clear.

1.4

Cranes must not be used to lift loads exceeding their maximum load capacity. The maximum load capacity is specified on each individual crane.

1.5

When two cranes are to operate in tandem, the coupling must be ordered separately, and a port representative must be present during the operation.

For complex tandem lifting operations, the crane hirer must prepare a sketch showing the load’s centre of gravity, the position of the rigging gear on the load, and the load distribution on each hook.

The Port of Kalundborg will assist in finding a suitable solution.

The cranes are designed exclusively for vertical lifting and must not be used in situations where they are subjected to angled pull. They must also not be used for releasing straps and chains when goods are resting on them, except when handling pipes, reinforced concrete bars or other round iron, or unbound flat and shaped iron with a dimension of less than 8 cm, provided that the weight of the goods does not exceed 3/5 of the crane’s permissible load.

1.6

Cranes equipped with a grab must not be used for any material other than that for which they are designed without the consent of the Port of Kalundborg. Furthermore, the Port reserves the right to determine the tasks for which the bulk hopper must be used.

1.7

When unloading goods with a grab from smaller ships, the hirer must ensure that a person is stationed at the hatch to control the grab.

2.

Booking of Cranes

2.0.

The Port of Kalundborg will, under all circumstances, strive to ensure that the necessary crane assistance is available, provided the unloading and loading operation falls within the usual working area of the port cranes.

2.1.

Cranes can be ordered or cancelled through the Port of Kalundborg at tel. +45 59 53 40 00. If the commencement time is before noon, the booking must be placed well in advance, but no later than 13.30 on the preceding normal working day (13.00 on Fridays).

2.2.

If overtime is required, the booking must be placed the day before during the Port’s normal working hours to ensure that the crane operator receives proper notice in accordance with the collective labour agreement.

2.3.

For overtime on Saturdays/Sundays and public holidays, bookings must be placed as early as possible, but no later than 12.00 noon on the preceding normal working day.

2.4.

If the booking deadlines are not met, crane operations can only be expected to be available with a minimum of two hours’ notice. If the crane needs to be relocated to another quay area, a longer notice period is required.

3

Liability

3.1.

The Port of Kalundborg’s role in crane hire is strictly limited to making the cranes and operators available, and the hirer is therefore fully responsible for supervision and instruction.

3.2.

The Port of Kalundborg accepts no liability for disruptions in crane operations.

3.3.

The Port of Kalundborg does not undertake the attachment of goods to cranes or the supply of necessary rigging gear.

3.4.

The hirer or the hirer’s representative directs the crane operations by instructing the crane operator on the crane’s movements and providing relevant information about the planned work. This information must be given in Danish. The hirer is consequently also responsible for ensuring appropriate coordination between the crane, the vessel, and all other parties involved in loading and unloading operations etc.

3.5.

The crane hirer is fully responsible for ensuring that the operation is organised in a safe and responsible manner in all respects and that it is carried out with due consideration for labour and environmental factors to the greatest extent possible, including taking into account weather conditions, as well as the design and structure of the vessels, and to stop the operation if necessary.

3.6.

The Port of Kalundborg accepts no liability for any damage that may occur to persons or property in connection with the use of the crane. Accordingly, the Port of Kalundborg does not accept liability for damage to a ship, its lining, ballast, and bottom tanks or similar structures, regardless of whether such damage results from a lack of or insufficient information about obstacles.

3.7.

The Port of Kalundborg is only liable for damage arising from the use of its cranes if the crane hirer proves that the damage resulted from errors or negligence on the part of Port of Kalundborg staff.

3.8.

The crane hirer is liable for all damages to the crane and its equipment that occurs during the hire period, including damages resulting from a lack of or insufficient information about obstacles, including those in the cargo hold.

4.

Limitation of liability

4.1.

If the Port of Kalundborg is found liable under any of the above provisions or is otherwise held or deemed liable, its liability shall be limited as follows:

Compensation is determined based on the value of goods of the same type at the time the damage is discovered. The value of the goods must be assessed according to the market price, or, if no market price is available, according to the usual value of goods of the same type and quality.

However, compensation cannot exceed SDR 666.67 per item or unit of goods, or SDR 2 per kilogram of gross weight of the damaged goods, whichever is greater.

Compensation for containers or other similar transport units with contents cannot exceed DKK 75,000.

No compensation will be paid for the hirer’s and/or third party’s operating losses, loss of time, loss of profit, loss of market share, loss of goodwill, waiting time for lorries and dock workers, or similar losses.

SDR refers to the unit of account as defined in section 505 of the Danish Merchant Shipping Act. SDR is converted into Danish currency based on the exchange rate applicable on the date the damage is discovered.

5.

Hiring priority

5.1.

Priority for crane hire is given to unloading and loading ships, followed by loading and unloading wagons, etc. Priority for unloading or loading with a crane generally follows the ships in their turn. In addition, the Port of Kalundborg determines priority and agrees with the hirer on which cranes will be used.

6.

Overtime work

6.1.

When a ship is waiting for a crane, the hirer using that crane is obliged to accelerate operations as much as possible and extend working hours by at least three overtime hours per day or operate in two shifts.

Failure to comply with this provision allows the Port of Kalundborg, at the end of normal working hours, to interrupt crane operations, order the ship to another berth, and make the crane available to the waiting ship.

6.2

The first ship in turn, or its consignee/shipper, is obliged to immediately utilise a crane whenever one becomes available between 07.00 and 20.00. Failure to meet this obligation will result in the crane being made available to the next ship that is ready to use it immediately.

7.

Cleaning

7.1.

Pollution (spillage) from loading and unloading must not extend beyond the ship’s working area on the quay.

7.2.

During loading and unloading, appropriate precautions must be taken, and spillage on quays and streets must be cleaned up to ensure compliance with applicable environmental requirements. Any instructions issued by the Port of Kalundborg must be followed.

7.3.

All affected areas must be cleaned immediately after completing unloading or loading, and no later than at the start of the next working day, to protect the environment and other users.

7.4.

All spillages must be collected and disposed of at an authorised recycling site in an environmentally appropriate manner. Spillage designated for recycling must not be deposited in port areas but must instead be collected and stored in containers.

7.5.

The company carrying out or arranging unloading and loading operations is responsible for cleaning. This includes the stevedoring company or the cargo owner, defined as the party paying cargo dues, port dues, or similar charges to the port.

The responsible party assumes all costs associated with cleaning.

7.6.

If cleaning is not carried out immediately after unloading or loading, the Port will arrange for cleaning to be performed on behalf of, and at the expense of, the responsible company.

7.7.

Crane work is not considered complete until the crane is clear of the track or, in the case of a mobile crane, free to leave the area.

7.8

If the Port of Kalundborg is to carry out the cleaning, this must be requested when booking the cranes. ***

8.

Rates

The rates for crane use are stated in the Port of Kalundborg’s “Prices, Terms and Conditions” for the relevant calendar year.

8.1

Crane hire is calculated from the time the crane is booked and made ready. A minimum charge of one hour applies, after which crane hire is charged per half-hour or part thereof.

8.2

Crane hire is payable to the Port of Kalundborg in accordance with the issued invoice.

For cash payment of crane hire, a Port of Kalundborg representative will issue a receipt for the amount.
