Crane regulations for the Port of Kalundborg
For information on the available cranes, please refer to the attached list.
The following terms and conditions apply to the rental of the cranes:
1.
The use of cranes
Subsection 1.1
The Port of Kalundborg makes the cranes available to the tenants with a driver.
It is the tenant's responsibility to familiarize themselves with the laws, ordinances, etc. that apply in connection with the rental/use of cranes, including, among other things, the rules set by the Ministry of Labor regarding use (hooking) – storage and marking of lifting equipment, as well as the design and use of cranes, and to ensure that these rules and regulations are complied with.
Section 1.2
The crane may not swing the cargo over a ship other than the one it is serving, and the crane operator is only obliged to operate the crane in ways that are compatible with the crane's design and operation.
Section 1.3
Electric cranes running on tracks must not be moved along the quay with loads. If it becomes necessary to move a quay crane, the crane lessor or his representative must ensure that the crane runway/track and cable trough are clear.
Section 1.4
The cranes must not be used to lift loads that exceed the maximum load. The maximum load is indicated on each crane.
Section 1.5
When two cranes are to work together, the connection must be ordered separately, and the port's representative must be present during the work.
For complicated joint lifts, the crane operator must prepare a sketch indicating the load's center of gravity and the location of the lifting gear on the load, as well as the load on each individual hook.
The Port of Kalundborg will be happy to help find a solution.
The cranes are only intended for vertical lifting and must not be used where they are exposed to oblique pull, nor used to release straps and chains when goods are lying on them, unless the goods are pipes, Monier iron or other round iron or unbound flat and shaped iron, the dimensions of which are less than 8 cm, all on the condition that the weight of the goods does not exceed 3/5 of the crane's permissible load.
Section 1.6
Those of the cranes that are equipped with a grab bucket (grab) may not be used for any material other than that for which they are intended without the consent of the Port of Kalundborg. Furthermore, the Port may decide for which tasks a unloading hopper must be used.
Section 1.7
When unloading goods with a grab bucket from smaller ships, the tenant must ensure that a man is stationed at the hatch to control the grab bucket.
2.
Order
Item 2.0
Under all circumstances, if the unloading and loading work is within the normal working area of the port cranes, the Port of Kalundborg will strive to ensure that the necessary crane assistance is available.
Subsection 2.1
The cranes are ordered/cancelled at Kalundborg Port (+45) 59 53 40 00If the start time is before noon, orders must be placed well in advance, but no later than the previous normal working day before 1:30 p.m. - Friday at 1:00 p.m.
Subsection 2.2
If overtime is desired, the order must be placed the day before within the port's normal working hours, in order to ensure that the crane operator is given proper notice in accordance with the collective agreement.
Section 2.3
For overtime on Saturdays/Sundays and public holidays, orders must be placed as early as possible, but no later than the previous normal working day before 12:00.
Section 2.4
If the order deadlines are not met, crane work can only be expected with 2 hours' notice. If the crane is to be moved to another quay area, longer notice is required.
3.
Responsibility
Subsection 3.1
The Port of Kalundborg's business in renting out cranes consists solely of making the cranes available with operators, and the lessee thus has the full obligation of supervision and instruction.
Section 3.2
The Port of Kalundborg assumes no responsibility for disruptions in the operation of the cranes.
Section 3.3
The Port of Kalundborg does not undertake the work of hanging the goods on the cranes or supply the necessary lifting equipment.
Section 3.4
The lessee or his representative directs the crane's work by advising the crane operator of the movements the crane must make and otherwise informing him of the planned work. The information must be in Danish. The lessee is thus also responsible for appropriate coordination between the crane, ship and others involved in loading and unloading operations, etc.
Section 3.5
The crane lessor has full responsibility for ensuring that the work is organised in a fully responsible manner in every respect and for the work to be carried out in such a way that occupational and environmental considerations are taken into account as best as possible, including consideration of weather conditions and the ships' layout and construction, and for stopping the work if necessary.
Section 3.6
The Port of Kalundborg assumes no liability for damage that may occur to persons or property in connection with the use of the crane. Accordingly, the Port of Kalundborg assumes no liability for damage to the ship and its equipment, ballast and bilge tanks or the like, regardless of whether this is due to lack of or insufficient information about obstacles.
Section 3.7
The Port of Kalundborg is solely responsible for damage arising in connection with the use of the Port of Kalundborg's cranes, if the crane lessee proves that the damage is due to errors or negligence caused by the personnel at the Port of Kalundborg.
Section 3.8
The crane lessee is responsible for all damage to the crane and crane equipment that occurs during the rental period, including damage caused by lack of or insufficient information about obstacles, including in the cargo hold.
4.
Responsibility request
Subsection 4.1
If the Port of Kalundborg is found liable under one of the above provisions or is otherwise held liable, or is otherwise found liable, liability is limited as follows:
Compensation is determined according to the value of goods of the same type at the time the damage is discovered. The value of the goods must be determined according to the market price – or, in the absence thereof, according to the usual value of goods of the same type and quality.
However, compensation cannot exceed 666.67 SDR for each package or other unit of the goods, or 2 SDR per kilogram gross weight of the goods that are damaged, whichever is the highest.
As far as containers or other similar transport units with contents are concerned, the compensation cannot exceed DKK 75,000.
Compensation for the tenant's and/or third party's operating losses, loss of time, loss of profit, lost market share, lost goodwill, waiting time for trucks and dock workers, etc. is not provided.
SDR means the unit of account referred to in section 505 of the Maritime Act. It is converted into Danish currency at the exchange rate on the day the damage is discovered.
5.
Preferred lease
Section 5.1
The cranes are rented primarily for unloading or loading ships and then for unloading and loading wagons, etc. The priority for unloading or loading with a crane generally follows the ships in turn. Otherwise, the Port of Kalundborg decides who has the priority and agrees with the tenant which of the cranes is to be used.
6.
Overtime
Section 6.1
When a ship is lying in wait to be brought to the crane, the tenant who is using the crane in question is obliged to speed up the work as much as possible and to extend the working hours by at least 3 overtime hours daily or work in 2-shift shifts.
If this provision is not complied with, the Port of Kalundborg may, at the end of normal working hours, interrupt the crane work in question, order the ship to another berth and make the crane available to the waiting ship.
Section 6.2
The ship that is first in line, or its cargo recipient/shipper, is obliged to immediately use a crane when one becomes available, regardless of the time between 7 a.m. and 8 p.m. If this obligation is not met, the crane will be made available to the next ship that wants to use it immediately.
7.
Cleaning
Subsection 7.1
Pollution (spill) in connection with loading and unloading must not spread outside the ship's working area on the quay.
Section 7.2
During loading and unloading, precautions must be taken and spills on quays and streets must be cleaned up to such an extent that applicable environmental requirements are met. The Port of Kalundborg's instructions must be followed.
Section 7.3
All affected areas are cleaned immediately after unloading or loading is completed, at the latest by the beginning of the following working day, out of consideration for the environment and other users.
Section 7.4
All waste must be collected and disposed of in an environmentally sound manner at an approved landfill. Waste that is to be recycled must not be deposited in the port areas, but must be collected and stored in containers.
Section 7.5
Responsibility for cleaning lies with the company – stevedore company – that performs or has performed unloading and loading work, or the goods owner, defined as the person who pays freight or quay dues or similar charges to the port.
The person responsible assumes all costs associated with the cleaning.
Section 7.6
If cleaning is not carried out immediately after unloading or loading is completed, the port will arrange for the cleaning to be carried out on behalf and at the expense of the responsible company.
Section 7.7
Crane work is not considered completed until the crane is clear of tracks, or in the case of a mobile crane, the crane can freely drive from the area.
Section 7.8
If the Port of Kalundborg is to carry out the cleaning, this must be notified at the same time as ordering cranes.***

8.
The tariffs
The rates for using the cranes are listed in the Kalundborg Port's Prices and Terms of Business for the calendar year in question.
Subsection 8.1.
Crane rental is calculated from the time the crane is ordered and made ready. A minimum of 1 hour is charged, then per half hour started.
Subsection 8.2.
The crane rental is paid to the Port of Kalundborg after submitting an invoice.
In cases where the crane rental is paid in cash, a receipt for the amount will be issued by the Port of Kalundborg's representative.
Entry into force.
These regulations are valid from 01.04.2019.
